City of Medford Common Council Meeting Minutes Tuesday, August 17, 2021 6:00 PM Council Chambers, City Hall 639 South Second Street Medford, WI {Subject to Council Approval} Call to Order/Roll Call Mayor Mike Wellner called the meeting to order with the following members present: Dave J. Brandner, Laura Holmes, Tim Hansen, Christine Weix, Dave Roiger, Michael Bub, and Clem Johnson. Alderperson Greg Knight was an excused absence, all vote tallies will be with the exception of Alderperson Knight.
Pledge of Allegiance
Alderperson Brandner began the meeting by leading the group in reciting of “The Pledge of Allegiance”.
Open Meeting Law Compliance Mayor Wellner announced that this was an open meeting of the Common Council. Notice of this meeting was given to the public at least 24 hours in advance of the meeting by forwarding the complete agenda to the official City newspaper, The Star News, and to all news media that have requested the same as well as posting. Copies of the complete agenda were available for inspection at the City Clerk’s office. Anyone desiring information as to forthcoming meetings should contact the City Clerk’s Office.
City Personnel Present
The following City personnel were present: City Clerk Ashley Lemke, Wastewater Superintendent Ben Brooks, Brooke Klingbeil, and City Coordinator Joe Harris. City Attorney Courtney Graff was an excused absence.

Transitioning from Fecal Coliform Testing to E. coli
Wastewater Treatment Plant Laboratory Director Brooke Klingbeil presented to Council a presentation to provide Wastewater Operators education on a newly revised administrative code pertaining to E. coli WPDES permit limitations. The presentation will be used for training purposes by the WDNR and will be presented to Council as well as at the WRWA and WWOA Technical Conferences.

Laura Holmes moved, Christine Weix seconded a motion to approve the August 3, 2021 Council, and August 9, 2021 Committee of the Whole meeting minutes as presented and to place the same on file in the Clerk’s Office. All in favor: All Aye. Motion Carried.
Resolution Authorizing the Submission of a Wisconsin Economic Development Corporation (WEDC) Cost-Share Grant Application Tim Hansen moved, Clem Johnson seconded a motion to suspend Council rules #13A & #13B and adopt Resolution #1893 that would authorize the submission of a Wisconsin Economic Development Corporation (WEDC) cost-share grant application and to authorize the commitment of cost share funds to be used as outlined in the WEDC application for the cost share amount of not to exceed $40,000.00, allocated from the undesignated reserve account. Resolution Authorizing the Submission of an Application for a Public Transportation 2022 Operating Assistance (Shared-Ride Taxi) Grant Laura Holmes moved, Dave Roiger seconded a motion to suspend Council Rules #13A & #13B, and adopt Resolution #1894 that authorizes the submission of an application for Public Transportation 2022 Operating Assistance (shared-ride Taxi) grant. Termination of Payment in Lieu of Taxes Agreement with Nestle for the Dog Park The City and Nestle negotiated a contract for private development for property located in Tax Increment District #12. Nestle planned to construct a parking on the property zoned I-1 (Light Industrial). As part of the agreement, Nestle agreed to a payment in lieu of taxes to the City. Nestle agreed that the payment in lieu of taxes would be based on assessed value of $225,000 until the tax year 2025. After the year 2025, Nestle will pay the taxes based on the actual assessed value.
Nestle is currently negotiating with a group of people whereby Nestle would donate this land for use as a dog park. This group is currently in the process of obtaining 501 C-3 status as a taxexempt organization. Once the group obtains this status, they will need to file the necessary paperwork with the City assessor.
Laura Holmes moved, Clem Johnson seconded a motion to allow the termination of the developer’s agreement effective December 31, 2021 under the following conditions: (1) The land is donated to the Dog Park organization. (2) Nestle will make the final payment for the 2021 tax year collected in 2022. (3) Should Nestle and the Dog Park organization fail to reach an agreement, the developer’s contract between the City and Nestle will continue until the year 2025. Roll Call Vote: Dave J. Hotel/Motel Room Tax Distribution Clem Johnson moved, Christine Weix seconded a motion to establish the distribution of the Hotel/Motel tax to be apportioned as the City receiving 15% and the Hotel/Motel receiving 85% for 2022. Repaving South Whelen Avenue Project Bid Award Dave Roiger moved, Laura Holmes seconded a motion to accept the bid submitted by American Asphalt in an amount not-to-exceed $49,805.60 with funds for this project allocated from the Construction Overlay account (#43-56320-36710). Coordinator’s Report
The Coordinator’s Report was as follows: (1) An update on
the Electric Utility projects was given. (2) An update on the Public Works projects was given. (3) An update on the Wastewater Utility projects was given. (4) Upcoming Special Events are Walk Together for Suicide Awareness to be held on September 10, 2021.
Communications from the Mayor Upcoming Meeting Schedule - The upcoming meeting schedule was distributed.
Open Book - Notice was received from the City Assessor that the revaluation is wrapping up, the reports are being sent to the Department of Revenue for Compliance Check. Due to the timing, Open Book that was previously scheduled for August 26, 2021 from 11 am - 3 pm will need to be rescheduled. More information will be provided when that date becomes available.
