City of Medford Common Council Meeting Minutes Tuesday, September 7, 2021 6:00 PM Council Chambers, City Hall 639 South Second Street, Medford, WI {Subject to Council Approval} Call to Order/Roll Call Mayor Mike Wellner called the meeting to order with the following members present: Dave J. Brandner, Laura Holmes, Tim Hansen, Dave Roiger, Michael Bub, and Clem Johnson. Alderperson Greg Knight and Alderperson Christine Weix were an excused absence, all vote tallies will be with the exception of Alderperson Knight and Alderperson Weix.
Pledge of Allegiance
Alderperson Roiger began the meeting by leading the group in reciting of “The Pledge of Allegiance”.
Open Meeting Law Compliance Mayor Wellner announced that this was an open meeting of the Common Council. Notice of this meeting was given to the public at least 24 hours in advance of the meeting by forwarding the complete agenda to the official City newspaper, The Star News, and to all news media that have requested the same as well as posting. Copies of the complete agenda were available for inspection at the City Clerk’s office. Anyone desiring information as to forthcoming meetings should contact the City Clerk’s Office.
City Personnel Present
The following City personnel were present: City Clerk Ashley Lemke, Deputy City Clerk Stacie Tanata, Wastewater Superintendent Ben Brooks, Electric Utility Manager Spence Titera, City Treasurer Kathy Tom, and City Coordinator Joe Harris. City Attorney Courtney Graff was an excused absence.

No citizens or delegations addressed the Council.
Approval: Minutes
Laura Holmes moved, Clem Johnson seconded a motion to approve the (1) August 17, 2021 Council; (2) August 23, 2021 Committee of the Whole; (3) August 23, 2021 Budget Review; (4) August 31, 2021 Special Council; and (5) August 31, 2021 Special Council Closed Session meeting minutes as presented and to place the same on file in the Clerk’s Office. All in favor: All Aye. Motion Carried.
Proposed Preliminary Plat for Edgewood Estates Chuck and Linda Gelhaus have presented a proposed plat for the subdivision of Lot 10 of the Roger’s Addition into 8 additional lots. Council reviewed the plat information.
Dave Roiger moved, Clem Johnson seconded a motion to recommend the preliminary plat for Edgewood Estates to the Plan Commission for review. All in Favor: All Aye. Motion Carried.
Issuance of Class A Liquor License Dave Roiger moved, Laura Holmes seconded a motion to approve the issuance of a Class A liquor license to Tasha Neitzel, d/b/a Vintage Naturals, for the period beginning September 8, 2021 and ending June 30, 2022 for the premise located at 209 South Main Street. All in favor: All Aye. Motion Carried.
Transfer of Premise - Class A Beer/Liquor License Laura Holmes moved, Dave Roiger seconded a motion to approve the transfer of Kwik Trip Inc. d/b/a Kwik Trip 351, Class A Beer/Liquor license to their new location, 823 East Perkins Street, they are currently located at 177 South Eighth Street for the period beginning October 21, 2021 and expiring June 30, 2022. All in favor: All Aye. Motion Carried.
Issuance of Cigarette License Laura Holmes moved, Dave Brandner seconded a motion to approve the issuance of a cigarette license application for Kwik Trip, Inc., d/b/a Kwik Trip 351, for the licensing period beginning October 21, 2021 and ending June 30, 2022 at the store located at 823 East Perkins Street. Motion Carried.
Change of Agent on Class A Beer/Liquor License Laura Holmes moved, Dave Roiger seconded a motion to approve the request the schedule for successor of agent change for Krist Oil Company d/b/a Krist Food Mart #75 to Elizabeth Hallam. All in favor: All Aye. Motion Carried.
Operator License Denial
A renewal of a regular operator’s license in the City was received for Angela Vesnefsky. It is the recommendation of the Medford Police Department to deny the application based upon the following reasons: 1. Applicant acknowledged check box on Page 3 fifth box “Applicant does not have any criminal or ordinance convictions that are related to the license requested. These include, but not limited, to: gambling, controlled substances, disorderly conduct, non-sufficient fund checks, battery in bar/ tavern, within the past two (2) years”. Background investigation found that Ms. Vesnefsky has been convicted for violating state statute 947.01 Disorderly Conduct on February 16, 2021.
2. Applicant indicated No on Page 5 for the question Have you EVER been convicted of any felony, misdemeanor, or ordinance violation other than minor traffic violations? If yes, please complete below. Background investigation indicates that Ms. Vesnefsky has failed to disclose four (4) other convictions; Theft, OWI, and two (2) Disorderly Conducts.
Ms. Vesnefsky may appeal this denial to the Common Council pursuant to Wisconsin Statutes §125.12(3).
Laura Holmes moved, Michael Bub seconded a motion to approve the recommendation from Police Chief Liske for the denial of a renewal regular operator’s license for Angela Vesnefsky for the following reasons: (1) Applicant acknowledged check box on Page 3, fifth box of the application stating Applicant does not have any criminal or ordinance convictions that are related to the license requested. These include, but not limited, to: gambling, controlled substances, disorderly conduct, non-sufficient fund checks, battery in bar/tavern, within the past two (2) years. and (2) Applicant indicated No on Page 5 for the question Have you EVER been convicted of any felony, misdemeanor, or ordinance violation other than minor traffic violations. The denial may be appealed to the Common Council pursuant to Wisconsin Statutes §125.12(3). All in favor: All Aye. Motion Carried.
Issuance of Private Well Permits Clem Johnson moved, Dave Roiger seconded a motion to the issuance of a two-year private well permit beginning retroactively to August 1, 2021 and ending July 31, 2023 to the following: (1) Sierra Pacific @ 575 South Whelen; (2) Pam Ouimette @ 1091 North Shattuck Street; and (3) Jon Rothmeier @ 1164 West Broadway Avenue. All in Favor: All Aye. Motion Carried.
Engineering Contract for Pep’s Drive and Funding for the Same Clem Johnson moved, Laura Holmes seconded a motion to approve the engineering contract with Ayres & Associates engineering services for the Pep’s Drive Housing Development at a cost not-to-exceed $47,500 with the monies from Construction Fund #43-5632036914. Roll Call Vote: Dave J. Brandner - Yes; Laura Holmes Yes; Greg Knight - Absent; Tim Hansen - Yes; Christine Weix Absent; Dave Roiger - Yes; Mike Bub - Yes; Clem Johnson - Yes. (6 Yes; 0 No; 2 Absent). Motion Carried.
Engineering Contract for the Downtown Park Renovation and Funding for the Same The Committee of the Whole, at its August 23, 2021 meeting recommend that Council approve the recommendation from the Park Project Committee for an engineering contract with Ayres & Associates for the design of a park pavilion in the City-owned parking lot located on Whelen Avenue at a cost notto- exceed $5,000. The tentative plan is to solicit bids and construct the pavilion in early 2022.
Additional discussion items included: (1) Concerns about funding for the project; (2) Design ideas; (3) Concerns about where the starting point of project; (4) The needs of the downtown; (5) Parking; (6) Updated vision presented to Council of what Phase 1 consists of.
Laura Holmes moved, Clem Johnson seconded a motion to approve the engineering contract with Ayres & Associates for the design of a park pavilion in the City-owned parking lot located on Whelen Avenue at a cost not-to-exceed $5,000. Monies for this contract are available in the Park Buildings account (#43-56320-35210). Roll Call Vote: Dave J. Brandner - Yes; Laura Holmes - Yes; Greg Knight - Absent; Tim Hansen - Yes; Christine Weix - Absent; Dave Roiger - Yes; Mike Bub No; Clem Johnson - Yes. (5 Yes; 1 No; 2 Absent). Motion Carried.
Pool Statistics
Council reviewed the monthly pool statistic report for the 2021 season. No Action Taken.
Adoption of the 2022 Enterprise & Special Revenue Fund Budgets Mayor Wellner asked if there were any objections to adopting the 2022 Enterprise & Special Revenue Budgets in their entirety. No objections were voiced.
Dave Roiger moved, Dave Brandner seconded a motion to approve the 2022 Enterprise & Special Revenue Budgets as follows: Enterprise Fund-2022 Anticipated Operating Expenses Room Tax*- $20,000.00 Special Revenue – Landfill $8,950.00 ARPA (American Rescue Plan Act)- $224,095 by 2024 Special Revenue – Skate Park-$0.00 Community Development Authority Fund-$259,690.00 Water Utility-$916,514.00 Refuse/Recycling**$423,750.00 Wastewater Utility$1,631,263.00 Electric Utiity-$10,298,100.00 Community Development Block Grant-$0.00 Tax Increment Finance District #5-$5,658.00 Tax Increment Finance District #6-$14,052.00 Tax Increment Finance District #10-$14,053.00 Tax Increment Finance District #7-$8,661.00 Tax Increment Finance District #8-$10,596.00 Tax Increment Finance District #12-$394,778.00 Tax Increment Finance District #11-$61,500.00 Tax Increment Finance District #13-$1,391,797.00 *The Hotel/Motel Room Tax Fund budget reflects the 85% allocation to the Hotel/Motel Room Tax Commission and 15% to the City General Fund.
